I agree with some of the comments below the article that being charged with sexual assault in this case is ridiculous. The teacher is clearly an idiot, should be charged with something though, and fired.
I hope they take some disciplinary action against the student too. She's no angel in this scenario. Spraying glue in the air? What the f**k?

This is a perfect example of what is wrong with our system. Teachers can't touch students anymore so they are no longer respected or listened to. He should not be disciplined for trying to control his class. Why was she even in there?

Corporal punishment doesn't work. I don't think he had any right to put his hands on her. The sexual assault charge is wrong though.

I disagree Tracy. I don't know how old you are, but I remember going to school and having the teachers, (Nuns till I was in 5th grade) smack the hell out of me when I did something wrong...It didn't happen often...Even in high school the principal and assistant principals would call you in to get "swats" if you screwed up. Back in those days, a kid getting arrested was the talk of the town, because the kids had far more respect for their elders, the law, and frankly, themselves.
Fast forward to the 80's and 90's when corporal punishment was banned...Every fourth person being charged with a violent crime is under the age of 25...
Now, in 2008, the statistics show that over 50% of violent crime is committed by people under 25. Lots of these kids have absolutely NO respect for anyone, or anything...including themselves.
Once you take away the boundaries and consequences for children, they start pushing the boundaries until no consequences matter to them...
This teacher is an idiot for swatting the girl...I have to agree, but what about the bratty good for nothing little snowflake??? She's out there laughing and texting all her friends about how smart and funny and cool she is because she can get away with what ever she wants to...I wish she would end up in Farmer Bob's neck of the woods!!

To everyone talking about "the good old days", when teachers could spank or smack a kid, and there was more respect, etc.
Take a look at violent crime rates, in general or just by juveniles. Back in the "good old days" they were MUCH higher compared to today. Spare me the lectures about how kids were so much better then, because the facts say otherwise.
So if you're so eager to draw some causality between hitting a kid and kids committing crimes, then the only conclusion can be that the policy in the last couple of decades of not laying a hand on a kid has produced less violent, more law abiding teens and young adults.

I was raised in the 80's and our teachers still beat the hell out of those who needed it! I agree that the lack of discipline is a huge problem in our schools today. In rural Georgia they do still administer "swats" as needed however. It needs to be more often in my opinion, but at least it is done sometimes!
This girl was being disrespectful and disruptive. I think the teacher needed to do something. Why was she not sited for assault for spraying glue at him? If we are going to trump up ridiculous charges to jam up the judicial system and cost the taxpayers money, may as well go all the way!

I agree. When I was in school in the '70s. The pricipal had a paddle (like ever frat house movie). The teachers didn't do their own, but just sent you to the principal's office... and for the most part, the parents defended the principal's efforts rather than defending their little snowflake.
The teacher in this case was clearly wrong too.

Ronbo, I believe you're drawing too large a conclusion here — that no spankings has led to less crime.
There are a lot of reasons for lower crime, and I'd argue that few of them are related to no spankings in school.
One reason is the longer prison sentences, which cuts down on recidivism, and another theory, albeit controversial, is that crime rates have been falling since the early 1990s because a lot of "bad kids" were never born. (Crimes rates began falling about 15 years after the legalization of abortion.)

I'm not a fan of teachers or school admin being the "punishers". It should be a humiliating / humbling experience, administrated thru the courts.

If the girl will not fallow the rules of a class than why allow her in a classroom. some people don't mind being stupid and some times take pride in it. this teacher may have overreacted a bit but nothing has hurt but a fools pride.
