buddy, it is correct, because she had the sex in the past. Here, "having" is the present participle, and "had" is the participle. It's called "historic present" tense or something like that.

Man, to be 16 again and have a teacher that looked like her. She even rented a room. What more could a guy ask for?
Back when I went to the one room school house, Ms. Wiggams was 80, had a wart on the end of her nose, and smelled like kerosene. These kids today don't know when they got it good.

The gagne story is a total witch hunt. She is not a molester at all, the kid was 16 for Petes sake. She just needs to be forced to resign the job and that's it, the law should just stay out of it as long as it was fully consensual. Fifteen to 30 in the clink for havin sex with a 16 year old is just wrong.
