Man sues after his photo appears in ad for prostate device
Next the 58-year-old man's photo are the words, "Now I can go like I'm 19 again!" The man says he's never suffered from prostate problems and that the advertisement alarmed his mother when she saw it. (Minneapolis Star Tribune)

This is moronic! It will be very easy for the company to prove he signed a release: they can produce is signature (or not). Of course, as MJ pointed out, if you pose for a marketing or a modeling company, I suspect you are planning on the photos being used (or did he take the photos at a private studio for his own use and they were stolen).

It's clear he just wants easy money and is not doing this due to principals, "Ramos claims to have lost economic opportunities because of the alleged misuse of his photograph. The lawsuit also claims he suffered emotional distress for being exploited for his race and portrayed as a person with prostate problems or sexual dysfunction."
If he truely lost economic opportunities, then he needs to sue the people who won't hire him for discrimination of perceived disability.
And, really, how does this exploit him due to his being hispanic? The add didn't state that the conidition was race-based. Assuming that somoene who is hispanic to possibly suffer from the same condition as the general population is the opposite of discrimination.

Strangely enough, they could use the other pictures, the one without the 'patterned shirt', and everything would be OK. So, I suggest they use those pictures and take out a full page add in the Sunday times.
But, perhaps he has discovered a link between patterned shirts and prostate cancer. I too have noticed that guys wearing plad shorts with black socks tend to have a higher incidence of prostate issues.
