President Bush is now safe from one mentally ill homeless man

nell I think any reasonable judge or examiner would look at the bipolar for the reason for the drugs and alcohol. You can't exactly take that guy's word for it.

Wishing misfortune on others and threatening misfortune on others are quite different.

However, TFA pointed out that there was no evidence that he planned to carry out any threat and implied that there was no way he could so I'm not certain prison is the way to go here.

I agree that the judicial system would evaluate his remarks--but they are *his* claims. And I am not sure that HIV status is irrelevant to his mental condition. HIV may not have caused his mental distress somatically, but having a potential fatal illness on your mind is mentally exhausting. When I had cancer, the mental distress was wrenching and literally changed the way I thought.

I am surprised that his competency wasn't brought up in the trial--the threats were made in psych unit.
