Defense lawyer jailed for making lewd gesture at judge

Adam Reposa "made a simulated masturbatory gesture with his hand while making eye contact" with the female judge. He was jailed briefly for his act. (Austin American-Statesman)

I was ready to flip off the piggies that pulled me over yesterday....they said I ran a stop sign when I CLEARLY didn't. It's ok though, I have proof that I didn't and when I go to traffic court, the charges will be dropped and those piggies will look like complete butt-monkeys.

Seriously though, that lawyer didn't deserve to be jailed for making a gesture...it's not like he touched her or anything. She's just being a B*TCH and over-exerting her authority just like those piggies I encountered yesterday.

To show contempt for the judge, well, that's good for a reservation for one at the crossbar motel. Shame he made bail, a night with potential clients might have had an interesting effect on his character.

If he really had any cojones, he would have refused bail.

Contumacious is an actual legal term, it comes Contumacy
--willful refusal to appear before a court or comply with a court order; can result in a finding of contempt of court

Well, I don't know what things are like where y'all live, but in this state directing "lewd gestures" at a judge would probably get you the death penalty compared to other things that you can do to get hit with contempt. Such as:

Wearing shorts, tanktops, shirts that expose the belly, jeans that show underwear of any kind, sandals (or no shoes at all), hats or head apparel of any kind, excessive jewelry, or anything ever remotely offensive on a t-shirt will get you 10 days if you do so in a courtroom. As will your cell phone (or pager) going off, answering your cell phone even if it's on silent ringer, using a laptop (unless you're an attorney), using a hand-held video game (or playing a game on your phone), ANY derogatory language directed at anyone at all (or no one in particular) that the judge can hear, or ANY derogatory gestures directed at anyone (or no one).

Plus, for good measure, when you are done seeing the judge about anything at all, the bailiffs will not allow you to leave the courtroom until they have run a NATIONWIDE warrants check on you and it comes up clean.

And I left out using a PDA, unless you're an attorney. Plus if someone has to bail you out, they will only accept EXACT AMOUNTS of money, down to the penny, because they won't make change. Even if you have too much cash.

OH! And the person that pays your bail ALSO gets a nationwide warrant check run after they're in the building, and will get arrested if it doesn't come up clean, no matter where the warrant is from. So, make sure Mama has taken care of that parking ticket before she runs down to spring you.

And speaking of beating, the jerk-off gesture this lawyer made was astonishingly unprofessional and inappropriate. Not sure it warrants jail time, though. That seems like an overreaction. And the fact that the judge wanted to refuse him bail...um...she appears to be taking it personally. Also unprofessional. Are they both in middle school or something?

I'll admit to not remembering who said what. But I'm kind of amazed that on a list where the consensus was that a woman should not be able to wear an eyebrow piercing to work the consensus is that a man making a sexual gesture to a judge in court while court is in session is having his free speech rights violated when he is cited for contempt.

What do you think he would do next time if he got away with that gesture?

Ohhhhhhhhhh, that is a HUGE NO NO. Any lawyer who does that in any court will get a night in the pokey. Dumb ass lawyer. He should know better than that. Just really dumb.

Moreover, this guy is an officer of the court. Courtrooms are a place of order and decorum, this is just showing contempt for the court. He should be ashamed of himself. I sure the hell know I was ashamed of my behavior. Made a mental note, never to mumble anything under your breath when the microphones are on!
